THESE TERMS AND CONDITIONS OF SERVICE GOVERNING YOUR USE OF JIBFOU INTERNET, PHONE AND OTHER SERVICES

  • All Our services are provided “as is” and “as available” without any warranties or conditions of any kind. We work hard to give you the best service possible and typically maintain 99.99% for better network availability but we do not guarantee that our services will be uninterrupted or available at all times.
  • We are also not liable for any harm, damages, loss of profits or opportunities that are caused through the use or reliance on our services, regardless of cause.
  • You understand and agrees that Jibfou does not guarantee that any particular amount of bandwidth on the network or that any speed or throughput of your connection to the network will be available to you. You understands and agree that the speed of the Internet Service provided at your site will vary depending upon a number of factors, including your computer system(s) and associated equipment (e.g., your sourced WiFi routers/access points, etc.), Internet traffic, and other factors such as system capacity limitations, events beyond Jibfou’s control, and system failures, modifications, upgrades and repairs. You understand that your wireless connections and use of wireless routers may be subject to greater fluctuations in speed and latency and may be adversely affected by interference, congestion, distance, and other outside factors
  • The internet is a public network and as a result we do not guarantee that any communication or use of our services is secure or protected from interception by unauthorized individuals.
  • You agree to use our service solely by the household or business as registered the account.
  • You will abide by all applicable laws and agree to indemnify and hold us harmless from all liabilities and expenses related to any violation of this agreement. In no case will we be held responsible for the actions or omissions of any subscriber or other individual that accesses our services.
  • In relation to any damages or regulatory proceedings that may have resulted from your negligence or your unlawful use of the Service or the equipment. In no event shall Jibfou, Employees, affiliates, or any other third-party provider who furnishes services to you in connection with this agreement or the service be liable for incidental, direct, indirect, special, punitive, exemplary or consequential damages, including but not limited to loss of data, loss of revenue or profits, or damages arising out of or in connection with the Customer’s use or inability to use the Services, including the inability to access emergency services via the Services at any time or from time to time, or any interruption or degradation of the services, except in the event the Customer’s inability to use Services was due to the intentional or gross fault of Jibfou.
  • You are not allowed to use our services for; distribute copyrighted material for which you are not authorized, distribute unsolicited bulk email (spam), transmit data that is unlawful, harassing, abusive or defamatory, knowingly transmit a virus, trojan or other harmful software program, hack, attack or otherwise cause damage to any computer networks, use our services in any way that would negatively affect our goodwill, fraudulently use the internet in any way, abuse or violate the privacy of others, abuse, harass, or threaten our employees or agents, provide us false, misleading or outdated information.
  • Cable Modem or other modems: You may obtain a cable modem from Jibfou or may purchase and use a cable modem purchased at retail from a third party, provided that such retail device has been tested, certified and approved within the industry.
  • You must return all equipment leased or given to you by Jibfou for free during promotions at the end of the lease period or agreement with Jibfou
  • Third Party Sites: When You uses the Internet Service and/or accesses to Jibfou web sites, you may encounter links allowing you to visit web sites operated or owned by third parties (“Third Party Site(s)”). Jibfou provides these links as a convenience and they are not under the control or ownership of Jibfou. The presence of a link to any Third Party Site is not an endorsement by Jibfou of the Third Party Site, an acknowledgment of any affiliation with its operators or owners, or a warranty of any type regarding any information or offer on the Third Party Site. Your use of any third party site is governed by the various legal agreements and policies posted at that web site.

TERMINATIONS:

  • Jibfou reserves the right to immediately suspend or disconnect your services. The agreement may be terminated at any time for default in payment and the outstanding balance is due immediately in full. You may choose to terminate your services with Jibfou at any time by contacting us and by making a full payment of all outstanding balance.

FORCE MAJEURE:

  • Jibfou’s services depend on other networks, cabling, facilities and certain equipment that are not in our control. Accordingly to any representation made by us regarding access performance, speeds, reliability, availability, use or consistency of the Website is on a “commercially reasonable efforts” basis; We cannot guarantee any minimum level regarding such performance, speed, reliability, availability, use or consistency, and data, messages, information or materials sent over the Internet may not be completely private, and your anonymity is not guaranteed.
  • Jibfou shall not be responsible for interruptions in Service caused by Force Majeure events which include, but are not limited to, such events as acts of god; terrorism, strikes; fire; war; riot; or government actions. If the Services are interrupted for a period of 48 consecutive hours or more that the Services are rendered unusable, Jibfou’s liability shall be limited to give you a cred on account for the period during which the Service(s) was interrupted on a pro-rated basis on the next bill or on the invoice covering the period in question, except in the event the interruption was due to the intentional or gross fault of Jibfou or its affiliates.

BILLING AND PAYMENTS:

  • Our services are prepaid and you will pay one month in advance.
  • Your first invoice will be prorated.
  • Invoices will be sent via e-mail only. Please make sure to notify us if your e-mail address changed, otherwise, your invoice will no longer be e-mailed or sent via mail but service will continue active.
  • Please note that we accept; PayPal, visa, MasterCard, American Express, E-transfer, direct bank deposit, online at BMO and Interac/Debit in our office. To pay by credit card please visit; www.jibfou.ca and click: Online Credit Card Payment.
  • For pre-authorized payment Plan, your scheduled withdrawal date will be either 1st or 10th or 20th of every month as agreed, subsequent withdrawals will be on the same dates of each month. If your bank is closed for holidays on any scheduled withdrawal date that funds will instead be deducted on the following business day.
  • Make sure that you have enough available funds in your account to cover your monthly service charges for pre-authorized payment plans.
  • Should there be a Non-Sufficient Funds (NSF) on that date please note that we will contact you and we will reattempt to withdraw 10 days later which will be either 1st or 10th or 20th of the Month.
  • There will be an NSF fee with the reattempt as shown on your invoice or contact us.
  • Your use of our services constitutes your acceptance of our Terms of Services above.
